This is particularly true given the requirement that the criminal judgment must be final. Reaching a final verdict involves a long series of legal proceedings and appeals that can span years, effectively turning the legal right into a \u201cdeferred right\u201d that fails to provide the necessary protection.<\/p>\n<p>ECWR stresses that the core issue is not a lack of laws or decisions, but rather the absence of effective and swift enforcement mechanisms. Thousands of women still navigate a complex judicial process to obtain rulings, followed by an even more complicated process to enforce them\u2014often rendering these judgments mere \u201cpaper judgments\u201d with little real-world effect.<\/p>\n<p>In this context, ECWR maintains that the state bears the ultimate responsibility for ensuring that alimony reaches its rightful recipients, as it is a right linked to life and the minimum standard of human dignity\u2014not merely a financial obligation between private parties.<\/p>\n<p>Accordingly, ECWR proposes a more effective framework based on:<\/p>\n<ul>\n<li>Treating alimony, in principle, as a debt owed to the state, whereby the state pays it immediately to beneficiaries (wives and children) and then recovers it from the obligated party using all available means.<\/li>\n<li>Using travel bans as a pressure mechanism to ensure repayment of this debt to the state, rather than tying them solely to lengthy litigation processes.<\/li>\n<li>Establishing swift and direct enforcement mechanisms so that travel bans are not contingent on final criminal rulings, but instead serve as an early and effective measure to ensure compliance.<\/li>\n<\/ul>\n<p>ECWR warns that without such a shift, evasion of alimony payments will continue for years, and the real burden will remain on women and children, despite the issuance of decisions that may appear deterrent on the surface.<\/p>\n<p>Nehad Aboul Komsan, ECWR\u2019s chairwoman and a cassation lawyer, said:<br \/>\n\u201cJustice in alimony cases is not achieved by issuing decisions, but by the speed of enforcement and the timely delivery of rights.
